Every INS/E-numbered additive we can decode, and its status in each country we've checked so far. "Not listed" is never the same claim as "banned" — most additives here are perfectly legal in India and simply haven't been reviewed or registered in the other country at all. Sunset Yellow FCF has been previously evaluated by JECFA and the SCF. Both committees established an Acceptable Daily Intake (ADI) of 0-2.5 mg/kg bw/day. The Panel also notes that the 90 day rat study used by JECFA to derive the ADI also reported effects on testes weight, occurring without accompanying histological changes, although sperm morphology and sperm mobility were not analysed. The Panel concludes that these findings do give reason for re-definition of the ADI. The Panel decided to reduce the ADI, by an extra uncertainty factor of 2.5, to 1 mg/kg bw/day and to make the ADI temporary for 2 years. Within this period, clarification of the effects of Sunset Yellow FCF on the testis, sperm morphology and sperm mobility should be provided, based on a 28-day study performed according to the recently updated OECD test guideline 407.

At the 97th meeting, JECFA considered additional toxicological studies relevant to the safety assessment of INS 171 that investigated the toxicokinetics, acute toxicity, short-term toxicity, longterm toxicity and carcinogenicity, genotoxicity, and reproductive and developmental toxicity, as well as special studies addressing the short-term initiation/promotion potential for colon cancer. JECFA identified a number of TiO2 test materials that were considered representative of INS 171. Further, JECFA recognized that a large number of toxicological studies have been conducted using test materials, including nanoparticles, having size distributions and physico-chemical properties not comparable to INS 171. These studies on non-representative materials were evaluated by JECFA , but it was concluded that they were not relevant to the safety assessment of INS 171. INS 171 was poorly absorbed from the gastrointestinal tract of mice and rats. No adverse effects were observed in short-term studies in mice and rats receiving INS 171 in the diet, with NOAELs of 15 000 mg/kg bw per day and 5000 mg/kg bw per day in mice and rats, respectively, the highest doses tested. JECFA noted that the available data did not provide convincing evidence of genotoxicity for INS 171, but recognized the limitations in current methodologies with respect to the testing of poorly soluble particulate materials. Although there were uncertainties in the genotoxicity data, JECFA took into account the fact that INS 171 was not carcinogenic in adequately conducted 2-year studies in mice and rats at doses of up to 7500 mg/kg bw per day for mice and 2500 mg/kg bw per day for rats, the highest doses tested. There was no evidence of reproductive or developmental toxicity in studies in rats at INS 171 doses up to 1000 mg/kg bw per day, the highest doses tested. The Panel noted uncertainties as regards the chemistry, the exposure assessment and biological and toxicological data. Overall, taking into account the lack of adequate data to address these uncertainties, the Panel concluded that the existing group ADI for carrageenan (E 407) and processed Eucheuma seaweed (E 407a) of 75 mg/kg bw per day should be considered temporary, whilst the database should be improved within 5 years after publication of this opinion. Within the given time frame, high importance should be ascribed to the establishment of an adequate interlaboratory validated analytical method to quantify, at the existing 5% limit, the low weight-average molecular weight fraction of carrageenan, and to establish whether or not this fraction is associated with health risks. The Panel further concluded that in the refined brand-loyal exposure assessment scenario the exposure estimates exceeded, in some cases by up to approximately 10-fold, the temporary existing ADI at the high level (95th percentile) for all population groups and at the mean for all population groups except for infants and the elderly. Although the exposure may be overestimated the extent of the exceedance of the ADI (10-fold) may be a safety concern.
